Pre-Booking Agreement
This Pre-Booking Agreement (the “Agreement”) is entered into between Aarogya Tech Inc. (“Aarogya Tech”) and the customer (“Customer”) who wishes to pre-book the Aarogya Health Companion (AHC) product (the “Product”) offered by Aarogya Tech. The terms and conditions of this Agreement shall be effective as of the date the Customer places their pre-order and makes the Pre-Order Payment (the “Pre-Order Date”).
Pre-Booking Fee:
a. The Customer agrees to pay an initial pre-booking fee of $49 (the “Pre-Order Payment”) at the time of placing the pre-order. b. The Pre-Order Payment is fully refundable and will be the Customer’s sole and exclusive remedy under this Agreement in case of cancellation or non-delivery of the Product.
Product Configuration:
a. The Product Configuration, including pricing (excluding taxes and official or government fees), will be confirmed with the Customer at a later date.
b. Aarogya Tech will provide the Customer with a Final Price Sheet as the delivery date approaches. The Final Price Sheet will include the final pricing based on the Product Configuration and will include taxes and official or governmental fees.
Limitation of Liability:
a. Aarogya Tech shall not be liable for any incidental, special, or consequential damages arising out of this Agreement.
b. The Customer’s sole and exclusive remedy under this Agreement shall be limited to reimbursement of the Pre-Order Payment.
Governing Law, Integration, Assignment:
a. The terms of this Agreement are governed by the laws of the State in which Aarogya Tech is licensed to sell products that is nearest to the Customer’s address indicated on their Product Configuration.
b. This Agreement supersedes any prior agreements, oral statements, negotiations, communications, or representations about the Product sold under this Agreement.
c. Terms relating to the pre-order not expressly contained herein are not binding.
d. Aarogya Tech reserves the right to assign this Agreement, at its discretion, to one of its affiliated entities.
Acceptance of Agreement:
By confirming and accepting this Agreement, the Customer agrees to the terms and conditions stated herein.
Information Collection and Sharing:
a. Aarogya Tech may collect three main types of information related to the Customer or their use of Aarogya Tech’s products and services:
Information from or about the Customer,
Information from or about the Customer’s health products,
Information from or about the Customer’s family.
b. Depending on the Aarogya products and services used by the Customer, not all of the above types of information may be applicable. c. Aarogya Tech may share information with:
Service providers, business partners, and affiliates of Aarogya Tech, Third parties authorized by the Customer, Other third parties as required by law
d. Aarogya Tech will limit the sharing of personal data and will do so only for purposes such as payment processing, order fulfillment, product installation, customer service, marketing, financing, service or repair, and other similar services.
By accepting this Agreement, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions stated herein.
